DViCO FusionHDTV7 USB TV Tuner: Tuner is busy. Error -19

I have a divco fusionhdtv7 usb tv tuner card that uses xc5000.fw which is in /lib/firmware.

The problem is that its not working and dmesg says it is busy.

[ 1903.216575] usb 1-1: Tuner is busy. Error -19

Hours of searching i managed to find a thread that talks about this very subject.

Im not a programmer, and i would love to watch tv on my laptop again. How does this get fixed?

Which kernel is used?
And please show us chip ID shows lsusb for this device

The firmware is active since kernel 2.6
